What Is A Foreclosure Audit?
A Foreclosure Audit is designed to help homeowners analyze the legality of the foreclosure action that has been taken against them by their lender/trustee company. In almost 95% of recent foreclosures, the lender/trustee have not followed the detailed set of legal procedures necessary to rightfully foreclose so an audit is essential to look for any potential violations, errors or discrepancies. Furthermore, many major lenders have committed outright fraud by falsely assigning the interest of your loan via a process called "robo-signing." Once these violations are identified, it is essentially an illegal foreclosure and your lender should have no legal right to foreclose until the issues are resolved. The trustee company has the legal responsibility to ensure a proper and accurate foreclosure so if there are violations, they can be held accountable and could face severe penalties or sanctions if they proceed with the trustee sale after being notified of their missteps.

The MCR 2 Step Process To DELAY Your Trustee Sale in Orange County:

Step 1: Review foreclosure documents recorded on your property.

Audit- The foreclosure audit process generally takes about 48-72 hours to complete (rush audits can be done in 24 hours).  Once the findings are completed, you will be notified of results and given a copy of the Title Review Summary (TRS).  Statistically speaking, 90-95% of audits will uncover violations and legal issues that will be strong enough to cause the delay of a trustee sale.  Your trustee has the legal responsibility to ensure a proper and accurate foreclosure so if there are violations, they can be held accountable and could face severe penalties or sanctions.

Step 2: If fraud is found, we notify the trustee.

Once we feel there is a legitimate case against the trustee, we will begin the trustee negotiation phase of the program.  We will contact the trustee with a Qualified Written Request letter outlining the specific violations found in the audit and negotiate the stoppage/postponement of the trustee sale process.  Every 30 days in this program from the program enrollment date, you will deposit monthly maintenance fee after the delay/cancellation has been confirmed.  During the time when there is no sale date, we will continue to monitor the trustee and pull title documents on a continual basis to see the progress your trustee has made in resolving the legal issues surrounding your foreclosure.  Our trustee specialists will ensure that everything is done to hold the trustee to the strict legal standard that they are supposed to follow and as a benefit to you, you will retain the ownership/possession of your home while in the program.
